Website management of m-gear.com.ua is carried out by the individual entrepreneur Mitasov Yevhen Valeriyovych, code according to EDRPOU 2974105433 (hereinafter referred to as the "Executor").
Please note that m-gear.com.ua publishes this Privacy Policy, prepared taking into account the latest changes in the legislation that regulates the protection of personal data, namely the General Data Protection Regulation (Regulation EU 2016/679 of 27.04.2016 or GDPR) and other relevant legislation.
1. GENERAL PROVISIONS:

2.1. This Privacy Policy describes the procedure for processing personal data collected through/by means of the m-gear.com.ua website and/or mobile application and other tools that allow users to post, delete, view ads and use other m-gear.com.ua functionality.
2.2. Personal data of m-gear.com.ua users is processed on secure servers that may be located both within and outside the European Economic Area.
2.3. By using the Site and/or m-gear.com.ua projects, the User agrees to the terms of this Privacy Policy and agrees to the processing of their personal data in accordance with these terms.

During the investigation or until consent is obtained, m-gear.com.ua may restrict the processing of the User's data by temporarily blocking their account.
4. PRIVACY POLICY:
4.1. This Privacy Policy establishes the obligations of m-gear.com.ua regarding non-disclosure and ensuring the protection of the confidentiality regime of personal data provided by the User to m-gear.com.ua.
4.2. Personal data allowed for processing under this Privacy Policy is provided by the User by filling out certain forms on the m-gear.com.ua website and/or in the m-gear.com.ua mobile application and may include the following information:
4.2.1. Full name;
4.2.2. Contact phone number;
4.2.3. Email address;
4.2.4. Place of residence and geolocation;
4.2.5. Messages transmitted to the User by other users and vice versa;
4.2.6. Other confidential data about the user's person or contacts.
4.3. In addition to the data provided in clause 4.2 of this Privacy Policy, m-gear.com.ua reserves the right to automatically collect the following data:

4.3.2. Information about Cookies data stored in the User's browser;
4.3.3. Information about pixels;
4.3.4. Information about the User's computing devices, including MAC addresses;
4.3.5. Information about the User's browser, including the name, version, etc.;
4.3.6. Access time;
4.3.7. Addresses to which the User accessed;
4.3.8. Addresses of previous pages from which access to the Site was obtained.
4.4. The User's refusal to collect Cookies may result in the inability to access parts of the Site and/or m-gear.com.ua projects.
4.5. Any other personal or confidential information not stipulated above provided by m-gear.com.ua shall be reliably stored and not disseminated, except in cases provided for by the clauses of this Privacy Policy.
5. PURPOSES OF COLLECTING PERSONAL INFORMATION:

6.1. m-gear.com.ua stores User Personal Data only as long as it is necessary for the purpose stated in this Privacy Policy.
6.2. If m-gear.com.ua does not require certain data about the User and it is not necessary to store them according to the requirements of the law, it will delete them or store them in a way that makes it impossible to identify the User.
7. METHODS, PROCEDURE AND TERMS OF PERSONAL INFORMATION PROCESSING:
7.1. Processing of User Personal Data is carried out without any time limitation, by any lawful means, including in personal data information systems using automation tools or without them.
7.2. By using the m-gear.com.ua website and/or the m-gear.com.ua mobile application and/or m-gear.com.ua projects, the User automatically agrees that m-gear.com.ua has the right to transfer personal data to third parties solely for the purpose of fulfilling the terms of the offer and this Policy.
7.3. User Personal Data may also be transferred to authorized state and judicial authorities upon lawful grounds and corresponding requirements.
7.4. In case of loss or disclosure of personal data, m-gear.com.ua informs the User about the loss or disclosure of personal data by any available means.
7.5. m-gear.com.ua takes the necessary organizational and technical measures to protect personal information from unauthorized or accidental access, destruction, distortion, blocking, copying, dissemination, as well as from other illegal actions of third parties.
7.6. m-gear.com.ua jointly with the User takes all necessary measures to prevent damages or other negative consequences caused by the loss or disclosure of User Personal Data.
8. INFORMATION SHARING:
8.1. As part of providing User access to the m-gear.com.ua service, the Performer may share information it collects about the User with third parties located outside Ukraine without the User's consent. In doing so, m-gear.com.ua will make efforts to ensure that the data transmitted is processed only for purposes that do not contradict this Privacy Policy.
8.2. The Performer undertakes not to rent or sell any personal data of the User. If the Performer's business or part of it is sold or reorganized, and the Performer transfers all or practically all of its assets to a new owner, users' personal data may be transferred to the buyer to ensure continuity of user service.
8.3. The Performer reserves the right to provide certain de-identified information (data that does not allow users to be identified individually) to third-party service providers, trusted partners, or authorized researchers for a better understanding of what advertising or services may be of interest to Users, improving the overall quality and effectiveness of m-gear.com.ua services. Such transmission is not considered a violation of this Privacy Policy.
9. INFORMATION DELETION:
9.1. Users who have created an account on m-gear.com.ua or posted an advertisement may independently delete the information they provided to m-gear.com.ua at any time by changing their account information in the settings of their profile on the m-gear.com.ua website or through the m-gear.com.ua mobile application.
9.2. In addition to the above, users may contact the administration of m-gear.com.ua at any time to delete their personal data. Requests for the deletion of personal data are accepted at the contacts indicated in the "Contacts" section posted on the Site's webpage and are processed within 10 calendar days from the date of receipt of the request.
10. RESPONSIBILITY OF PARTIES:
10.1. In case of loss or disclosure of Personal Information, the Administration of M-GEAR UKRAINE is not responsible if the information:
10.1.1. Was or became public at the time of loss or disclosure.
10.1.2. Was obtained from a third party before being received by the site Administration.
10.1.3. Was disclosed with the User's consent.
10.2. The Administration of m-gear.com.ua is responsible in all cases not covered by this clause, in accordance with the current legislation of Ukraine.
11. RESOLUTION PROCEDURE:
11.1. All disputes and discrepancies related to the performance of the conditions of this Policy are resolved by the parties through negotiations.
11.2. In case the parties cannot come to a mutual agreement through negotiations, or if one of the parties avoids negotiations, the dispute is transferred to court for resolution in accordance with the legislation of Ukraine.
12. ADDITIONAL CONDITIONS:
12.1. M-GEAR UKRAINE has the right to make changes to this Privacy Policy without the consent or notification of the User.
12.2. The new Privacy Policy comes into effect at the time of its publication on the Site, unless otherwise specified in the new edition of the Privacy Policy.
12.3. If the Executor has made any changes to the Privacy Policy that the User does not agree with, they are obliged to cease using m-gear.com.ua.
12.4. The text of this Privacy Policy is presented in Ukrainian and can be presented in foreign languages, with the Ukrainian version having priority in any disputed issues.
